Mozambique Decriminalises Homosexuality, Abortion

Mozambique has decriminalised homosexuality after a colonial-era penal code fell away.

The same penal code from 1886 also decriminalised abortion.

Homosexuality was theoretically punishable by three years hard labour but no known prosecutions have been made since independence in 1975.

Most African countries ban homosexuality and Zimbabwe’s new constitution while expressly denying right to gay marriage is silent on homosexuality.

However the old criminal code which has not been struck down means that people can be charged with sodomy although this is very rare.
