Gweru man jailed after burning two properties over jokes

A 46-year-old Gweru man, Joseph McCarthy, has been sentenced will spend an effective two years in prison after the Gweru Magistrates’ Court found him guilty of assault and malicious damage to two properties, the National Prosecuting Authority (NPA) is reporting.

The case

The incident occurred on April 17th when McCarthy and the complainant’s brother, Rodreck Munyanyiwa, were drinking together at Woodlands Shops in Gweru. A joke made by Rodreck angered McCarthy, who then went to the complainant Munyaradzi Munyanyiwa’s residence looking for Rodreck.

Unable to find Rodreck, McCarthy attacked Munyaradzi, injuring his eye. Munyaradzi managed to escape and McCarthy set fire to his blanket, destroying the room. The fire spread to a neighboring house belonging to Rebecca Nyathi, burning it down completely.

McCarthy fled the scene but later confessed to a security guard at the Woodlands Phase I Shops. He was apprehended by Munyaradzi and his neighbors and handed over to the police.

The total value of the damaged property is estimated at US$22,415.

The sentencing

McCarthy was sentenced to 10 years imprisonment with a three-year suspension. A further four years were conditionally suspended on the of payment of US$21,000 in restitution to Rebecca Nyathi for the damages caused to her house. Additionally, one year was conditionally suspended on the payment of US$755 to Munyaradzi Munyanyiwa for the damages to his property.

After serving the suspended sentences, McCarthy will effectively serve two years in prison.
