Zimbabwe gazettes new regulation that will make foreign currency use illegal locally with penalties

A new statutory instrument 213 of 2019 is out, and it is an Exchange Control Regulations one.

And it is huge fam.

These are the main things to pick up from it:

• Enforces the exclusive use of ZWL for domestic transactions goods/ services in Zimbabwe
• It illegalises the selling or paying of goods/services in USD or other currency except ZWL

And there are civil and criminal penalties that have been declared.

Constitutional lawyer Fadzayi Mahere had some criticism of the instrument:

Legally speaking, those regulations can’t impose criminal sanctions. As a matter of law, it’s incompetent to create criminal offences by way of a statutory instrument or delegated legislation. Parliament cannot delegate its primary law-making power – see s134 of the Constitution.
