Malaba no longer Chief Justice – High Court

A Zimbabwe High Court has said that Luke Malaba ceased to be Chief Justice when his term expired.

His term of office expired on 15 May 2021 at 00.00hrs.

Justice Happias Zhou read out the summary of the judgement, on 16 May 2021 in Harare, saying, “In view of the decision that we have reached, Hon Malaba ceased being a judge and Chief Justice at 0000hrs on 15 May 2021.”

The court further said that an extension, as given by President Emmerson Mnangagwa this week, does not apply to any sitting judges of the Constitutional Court and Supreme Court.

Updated: The Judicial Services Commission has appointed Justice Elizabeth Gwaunza as acting Chief Justice, pending the appeal of the decision of the court.
