Bikita West legislator, Munyaradzi Kereke has approached the Supreme Court over a High Court decision to have him prosecuted on a rape charge.
Prosecutor Johannes Tomana had declined to prosecute Kereke because of lack of evidence but the High Court said a private prosecution order needs to be issued against him.
The minor’s guardian, Francis Maramwidze, had approached the court to seek such an order saying that the 12 year-old’s right to justice had been infringed.
Kereke says not every case where the PG declines to prosecute must be issued must be proceeded by such an order.
Kereke maintains his innocence and says the charges are due to his ongoing feud with his erstwhile boss Gideon Gono.
