Kenya wants to jail, fine bosses who call their employees after work

A bill has been introduced to Kenya’s legislature which aims to limit the way bosses can get in touch with workers outside working hours.

The Employment (Amendment) Bill, 2021 (the “2021 Bill”) was first introduced then but because bills fall away after elections, the new administration has brought it back.

So what does it say?

The Employment (Amendment) Bill, 2022, fronted by Nandi Senator Samson Cherarkey, proposes to introduce a law preventing employers from interfering with workers except with a new exemption. It narrows it down to calls being made in an emergency which falls under what the employee’s duties are.

And the penalty?  Ksh500,000 (USD4,020) fine or be jailed for one year.

Other provisions say the employer should consult employees or their unions on policy. Add to that, compensation should be set out for overtime.
