The murder conviction against South African hip hop star Molemo “Jub Jub” Maarohanye and Themba Tshabalala have ben overturned by a Gauteng Court.
They will now be converted to culpable homicide.
The sentences were seen as setting a precedent for dolus eventualis cases in the country. It seems to also take a precedent from the recent conviction of paralympian Oscar Pistorius of culpable homicide in the killing of his girlfriend Reeva Steenkamp on 14 February 2014.
The judge says the decision was made because Jub Jub was not in control of his faculties given the drugs he had taken had altered his mental state.
The pair’s sentence has now been reduced to 10 years dating bacck to October 2012 when they received a life sentences for the killing four pedestrian children.
