Constitutional Court throws out Chamisa application, ED keeps presidency

A full bench of the Constitutional Court in Harare has thrown out the application by MDC Alliance leader Nelson Chamisa’s challenge of the declaration of Zanu PF’s Emmerson Mnangagwa as winner of the 30 July Presidential elections.

Chief Justice Luke Malaba indicated that Chamisa’s application was made within seven days as by law but was served in eight days. 

CJ Malaba added that the burden of proof lay with the applicant and that the Chamisa had failed to provide such proof.

The court said the applicant failed to provide ‘proof that the irregularities’ presented materially affected the election result.

The application was dismissed with costs and Mnangagwa is duly declared winner of the elections of 30 July 2018.
