A Zambian national, Mutaba Lambert Kunda (28), has been jailed after he was arraigned before the Mutare Magistrates’ Court facing two counts of robbery, the National Prosecuting Authority (NPA) is reporting.
He was also convicted of contravening the Immigration Act in that he entered Zimbabwe without a permit.
The case
The state presented and proved that on 8 June 2024 at around 1425 hours at Palmerston in Mutare, the accused person found the first complainant, aged 11, watering the garden outside the yard. Kunda asked him about the whereabouts of his parents. When he discovered that they were not at home, he proceeded to the next yard, where he jumped over the wall and entered the complainant’s yard. Upon entering the yard, he met the complainant and force-marched him at knifepoint into the house, where he took an HP Pavillion laptop, laptop bag and a Samsung iPad A7 from one of the spare bedrooms.
Kunda also demanded a Samsung Galaxy A13 cell phone, an ethernet adapter and two power packs from another 11-year-old complainant in the house.
The accused person was arrested on 13 June 2024. The total amount of the stolen property was USD2,200, and the value recovered was USD2,000. In the third count, the accused person was charged for staying in Zimbabwe without a permit.
The sentencing
The accused person was sentenced to 5 years imprisonment on the first and second counts, of which 22 months were suspended for five years.
On count three, he was sentenced to pay a fine of USD30, and in default of payment, he will serve 15 days imprisonment.
